Jemshah E-learning respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain and protect personal data when you use jemshah.com, a Jemshah learner account, our course and lesson features, or a Jemshah mobile application that links to this Policy. Jemshah E-learning may also appear in mobile-app listings as JEMSHAH ONLINE LEARNING.

1. Who is responsible for your data

Jemshah E-learning is responsible for deciding how personal data covered by this Policy is used. Questions and data-rights requests may be sent to info@jemshah.com or through our Contact page. You may also contact us on WhatsApp at +254 708 054 378.

2. Personal data we collect

The information collected depends on how you use Jemshah and may include:

Account and profile data: name, username, email address, phone number and profile image where provided.
Google Sign-In data: if you choose “Sign in with Google,” Google may provide your name, email address and profile image according to the permissions shown to you.
Learning activity: course enrolments, lessons viewed, progress, quiz attempts and results, completion records, wishlists, reviews and downloads where those features are used.
Support and communication data: messages, correction reports, enquiries and any information you choose to send through our contact form, email or WhatsApp.
Transaction and access data: the item or subscription purchased, amount, currency, transaction reference, payment status and the access granted. Payment providers process the sensitive payment credentials they require; Jemshah does not receive or store full payment-card details.
Technical and usage data: IP address, browser and device type, operating system, referring page, pages viewed, approximate location derived from IP, timestamps, cookie or advertising identifiers, and security or diagnostic logs.
Content you submit: comments, reviews or other material you voluntarily post where those features are available.

3. How we collect data

We collect data directly from you when you register, learn, purchase access or contact us; automatically through cookies, logs and similar technologies; and from service providers such as Google Sign-In and the payment provider shown at checkout.

4. Why we use personal data

We use personal data only where we have a lawful reason, including to:

create and secure accounts, authenticate users and provide courses, lessons and learner progress;
process purchases, confirm access and keep transaction records;
answer enquiries, investigate correction reports and provide support;
operate, troubleshoot, protect and improve the website and applications;
measure site use, understand content performance and maintain relevant advertising;
send essential service, security or transaction notices;
prevent fraud, misuse, scraping and unauthorised access; and
comply with legal, accounting, regulatory and dispute-resolution obligations.

Depending on the activity, our lawful basis may be performance of a contract, your consent, compliance with law, or our legitimate interest in operating and protecting an educational service. Where processing relies on consent, you may withdraw that consent, although this does not affect earlier lawful processing.

5. Cookies, analytics, advertising and Google services

Jemshah uses essential cookies for account login, security, preferences and course functions. We also use or may use the following services:

Google Analytics and Google Tag Manager to understand website use and measure events;
Google AdSense and DoubleClick to deliver, limit, personalise where permitted, and measure advertisements;
Sign in with Google for optional account authentication;
Google reCAPTCHA to reduce spam and abuse;
Google Fonts and embedded Google or YouTube content to display content and media; and
Cloudflare for security, performance and traffic insights.

These providers may receive technical information such as your IP address, device information, page activity and cookie or advertising identifiers. Advertising choices may depend on your location, consent, browser settings and the provider’s rules. You can control cookies through your browser and through any consent controls displayed on the site. Blocking essential cookies may prevent login or course features from working.

If you contact us through WhatsApp, WhatsApp and Meta process your account and message data under their own terms and privacy policy.

6. Payments

Payments are handled by the provider shown at the point of purchase, such as Google Play for eligible mobile-app purchases or another displayed payment service. The provider may collect payment credentials, billing information and fraud-prevention data under its own privacy policy. Jemshah generally receives transaction details needed to confirm payment, provide access, handle support and maintain records.

We may share only the data reasonably necessary with:

website hosting, security, email, analytics, advertising, authentication, support and payment providers;
professional advisers or service providers bound by appropriate duties;
government authorities, regulators, courts or law-enforcement bodies where required or permitted by law; and
a successor operator if the service is reorganised or transferred, subject to applicable safeguards.

We do not sell or rent your personal data.

8. International processing

Some technology providers may process information outside Kenya. Where personal data is transferred internationally, we take reasonable steps to use providers and safeguards consistent with applicable data-protection requirements.

9. Data retention

We keep personal data only for as long as it is reasonably needed for the purpose collected. Account and learning records may be retained while an account is active; support records until an issue is resolved; and transaction, security or legal records for the period required by law or reasonably needed to protect users and the service. Data that is no longer required is deleted, anonymised or securely restricted where practicable.

10. Security

We use reasonable technical and organisational safeguards designed to protect personal data against loss, misuse, alteration and unauthorised access. No website, application or transmission method is completely secure, so users should also protect their passwords and devices and notify us of suspected account misuse.

11. Your data-protection rights

Under Kenya’s Data Protection Act, 2019 and other applicable laws, you may have the right to be informed about use of your data, access it, object to certain processing, correct inaccurate or misleading data, request deletion where legally available, and withdraw consent. You may also object to direct marketing and to certain solely automated decisions.

To make a request, email info@jemshah.com with enough information for us to identify the relevant account and request. We may need to verify your identity. You may lodge a complaint with Kenya’s Office of the Data Protection Commissioner. We encourage you to contact us first so we can try to resolve the issue.

12. Children and student users

Jemshah provides educational material and may be used by learners under 18. A child should use account, payment and communication features with the involvement of a parent or legal guardian where consent is required. We do not knowingly ask a child to provide more personal data than is reasonably needed for the relevant service. A parent or guardian who believes a child’s data has been provided improperly may contact us to request review or deletion.

13. Communications and marketing

We may send essential account, purchase, security and service messages. Where we send optional promotional communication, you may unsubscribe or object to further direct marketing. Service notices necessary to operate an account may continue while the account remains active.

14. Third-party links and embedded content

Courses and pages may contain links or embeds from other websites. Those services may collect data when you interact with them and are governed by their own privacy policies. Jemshah is not responsible for a third party’s privacy practices.

15. Changes to this Policy

We may update this Policy when our services, providers or legal duties change. The revised date will appear at the top. Material changes will be highlighted or otherwise communicated where reasonably required.
